Pets Club Terms and Conditions

1. Agreement to Terms
Welcome to Pets Club. These Terms and Conditions ("Terms") govern your use of the Pets Club mobile application and web platform (collectively, the "Service" or "App") operated by Pets Club OOD ("Pets Club," "we," "our," or "us"). By downloading, installing, accessing, or using the Service in any form, you agree to be bound by these Terms. If you do not agree, do not use the Service.
2. Description of Service
Pets Club is a pet management platform available as a mobile application (iOS) and a web application at petsclubapp.com. It allows users to:
- Create and manage animal profiles
- Track vaccination records and health information
- Store diplomas and certifications
- Record zoometric measurements
- Create family trees for animals
- Export health records and family trees as PDF documents
2.1 Free vs. Paid Features
Certain features are available to all registered users free of charge, while others require an active paid subscription. The following features are available on the free plan:
- 1 animal profile
- Health records and vaccination tracking
- Zoometric measurements (latest value only)
- Documents and certificates storage
- Newsletter article previews
The following features require an active paid subscription (Core, Plus, or Pro):
- Multiple animal profiles (up to plan limit)
- Measurement history and charts
- Family tree (pedigree) management
- Push notifications and reminders
- Full newsletter article access
2.2 Feeding Schedules (Food Timers)
The App allows you to create and manage feeding schedules for your pets. You can set meal types (breakfast, lunch, dinner), quantities, time-based reminders, and link schedules to specific animals. Feeding reminders via push notifications are available exclusively to users with an active subscription.
2.3 Tasks and Reminders
The App provides a task management system for pet-related activities such as vet appointments, medication schedules, grooming, and other reminders. Tasks can be linked to one or more animals and include scheduled push notifications. Push notification delivery requires an active subscription.
2.4 Live Activities
The App may display real-time information about your active tasks and feeding schedules on your device's Lock Screen via iOS Live Activities. You can interact with Live Activities to mark tasks or feeding schedules as completed without opening the App.
2.5 Newsletter and Promotions
The Service provides personalized articles, tips, and promotional content from third-party companies related to pet care. Article previews are visible to all visitors. Full article access within the account dashboard requires a registered account. Promoted content is clearly marked as “Sponsored.” Pets Club does not sell your personal data to advertisers.
2.6 Web Platform
The Pets Club web application at petsclubapp.com provides access to account management, animal profiles, health records, measurements, documents, pedigree, newsletter, and subscription information. The web platform shares the same account credentials as the mobile application. Subscriptions cannot be purchased directly through the web platform — all billing is processed through the Apple App Store (iOS) or Google Play Store (Android).
2.7 Analytics and Data Sharing
The Service collects anonymous usage data to improve the user experience. This includes feature usage patterns, app performance metrics, and crash reports. Analytics data collection is opt-in and can be disabled at any time from the Settings screen. We use Firebase Analytics and Firebase Crashlytics for this purpose. On the web platform, we also use Meta Pixel (with your consent) to measure advertising effectiveness, and browser cookies and local storage for session management (see Section 10.1).
3. Eligibility
To use the App, you must:
- Be at least 13 years of age (18 to make purchases)
- Have the legal capacity to enter into binding agreements
- Not be prohibited from using the App by applicable laws
Users under 18 may only use the App with parental or legal guardian consent.
4. Account Registration
4.1 Account Creation
You must provide a valid email address, a secure password, and your name. Passwords must be at least 8 characters long and contain at least one uppercase letter, one number, and one special character. You may also sign in using Apple or Google accounts.
4.2 Account Security
You are responsible for maintaining the confidentiality of your credentials, all activities that occur under your account, and notifying us immediately of any unauthorized access.
4.3 Account Accuracy
You agree to provide accurate, current, and complete information and to update it as necessary.
5. Subscription Plans and Payments
5.1 Subscription Tiers
- Core (Bronze): Up to 5 animals with basic pet management and health tracking
- Plus (Silver): Up to 10 animals with all Core features plus extended storage
- Pro (Gold): Unlimited animals with all features and priority support
5.2 Billing
Subscriptions are billed through the Apple App Store (iOS devices) or Google Play Store (Android devices). Monthly or annual billing cycles are available, with annual subscriptions offering discounted rates.
5.3 Free Trial
Free trials, if offered, are available only to new subscribers, automatically convert to paid subscriptions unless cancelled, and may only be used once per Apple ID or Google account.
5.4 Automatic Renewal
Subscriptions automatically renew unless cancelled at least 24 hours before the end of the current period. Your Apple ID or Google account will be charged within 24 hours prior to renewal. You can manage and cancel subscriptions in your Apple ID Account Settings or Google Play subscription settings.
5.5 Refunds
All purchases are processed through the Apple App Store or Google Play Store. Refund requests must follow Apple's or Google's refund policies respectively. We do not process refunds directly.
5.6 Price Changes
We reserve the right to change subscription prices with advance notice. Price changes will not affect the current billing period and will take effect at the next renewal.
5.7 Promotional Codes
Pets Club may issue promotional codes that grant temporary access to subscription features at no cost. Promotional codes are single-use, tied to a specific email address, and have an expiration date. Misuse of promotional codes, including sharing, selling, or attempting to redeem codes not issued to you, may result in account suspension.
6. User Content
6.1 Your Content
You retain ownership of all content you submit to the App, including animal profiles, photos, health records, certificates, documents, and family tree data.
6.2 License Grant
By submitting content, you grant us a non-exclusive, worldwide, royalty-free license to use, store, and process your content solely for the purpose of providing and improving our services.
6.3 Content Restrictions
You agree not to upload content that:
- Infringes intellectual property rights
- Contains malware or malicious code
- Is illegal, obscene, or offensive
- Violates the privacy of third parties
- Misrepresents your identity
6.4 Content Removal
We reserve the right to remove content that violates these Terms without prior notice.
7. Acceptable Use
7.1 Permitted Use
The App is intended for personal, non-commercial use for managing your animals' information and for lawful purposes in compliance with applicable laws.
7.2 Prohibited Activities
You agree not to:
- Use the App for illegal activities
- Attempt unauthorized access to our systems
- Interfere with App functionality
- Reverse engineer the App
- Use automated systems to access the App
- Share your account credentials
- Create multiple accounts for fraudulent purposes
- Resell access to the App
- Remove any proprietary notices
8. Intellectual Property
8.1 Our Property
The App, including its design, features, content, and underlying technology, is owned by Pets Club and protected by copyright, trademark, and other intellectual property laws.
8.2 Limited License
We grant you a limited, non-exclusive, non-transferable, revocable license to use the App for personal purposes in accordance with these Terms.
8.3 Trademarks
“Pets Club” and related marks are our trademarks and may not be used without written permission.
9. Third-Party Services
9.1 Third-Party Integrations
The App integrates with the following third-party services: Apple App Store, Google Play Store, RevenueCat (subscription management), OneSignal (push notifications and Live Activities), Amazon Web Services (data storage), Firebase (analytics and crash reporting), Meta Platforms (Meta Pixel — web advertising measurement, consent-based), Google Sign-In, and Apple Sign-In.
9.2 Third-Party Terms
Your use of third-party services is subject to their respective terms and privacy policies. We are not responsible for third-party services.
10. Privacy
Your privacy is important to us. Please review our Privacy Policy to understand how we collect, use, and protect your information.
10.1 Cookies and Local Storage (Web Platform)
When you use the Pets Club web platform, we use cookies and browser local storage in three categories, which you can manage via the cookie consent banner:
- Necessary: session management and language/preference storage. Always active.
- Analytics: anonymous usage data via Firebase Analytics. Active only with your consent.
- Marketing: Meta Pixel for measuring advertising campaign effectiveness. Active only with your consent. No personal data is sold to third parties.
You can update your cookie preferences at any time by clearing your browser's local storage, which will also log you out and show the consent banner again on your next visit. For more information see our Privacy Policy.
11. Disclaimers
11.1 “As Is” Service
THE APP IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
11.2 No Medical Advice
The App is a record-keeping tool and does not provide veterinary advice. Always consult qualified veterinarians for your animals' health needs.
11.3 Data Accuracy
We do not guarantee the accuracy, completeness, or reliability of any content stored in the App. You are responsible for verifying the accuracy of your records.
11.4 Service Availability
We do not guarantee uninterrupted, continuous, or error-free operation of the App.
12. Limitation of Liability
12.1 Exclusion of Damages
To the maximum extent permitted by law, we shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, goodwill, service interruptions, or system failures.
12.2 Liability Cap
Our total liability for all claims arising from or related to the App shall not exceed the amounts you have paid to us in the preceding twelve (12) months, or 100 EUR, whichever is greater.
12.3 Essential Purpose
In jurisdictions that do not allow the exclusion of liability, our liability shall be limited to the maximum extent permitted by law.
13. Indemnification
You agree to indemnify, defend, and hold harmless Pets Club and its officers, directors, employees, and agents from and against any claims, damages, losses, or expenses arising from your use of the App, violation of these Terms, violation of any third-party rights, or content you submit through the App.
14. Account Termination
14.1 Termination by You
You may delete your account at any time through the App Settings. Upon deletion, your personal data will be permanently removed. Active subscriptions are not automatically refunded and must be cancelled separately through Apple.
14.2 Termination by Us
We may suspend or terminate your account for violation of these Terms, fraudulent activity, legal requirements, or discontinuation of the App.
14.3 Effect of Termination
Upon termination, your license to use the App ends immediately. You remain liable for any outstanding obligations. Provisions that by their nature should survive termination shall continue in effect.
15. Modifications to Terms
We reserve the right to modify these Terms at any time. Changes take effect upon posting in the App. Your continued use of the App constitutes acceptance of modified Terms. We will provide advance notice of material changes through the App or email.
16. Modifications to Service
We reserve the right to modify, suspend, or discontinue any part of the App, change features or functionality, and impose limits on certain features. We will endeavor to provide notice of significant changes.
16.1 Minimum App Version
Pets Club may require users to update to a minimum version of the App to continue using the Service. When a newer version is available on the App Store or Google Play Store, the App may display a mandatory update screen until the update is completed. This is necessary to ensure security, stability, and compatibility with our backend services.
17. Governing Law and Jurisdiction
17.1 Governing Law
These Terms are governed by the laws of the Republic of Bulgaria, without regard to conflict of law principles.
17.2 Jurisdiction
Any disputes arising from these Terms shall be resolved in the courts of Sofia, Bulgaria, to which you consent for personal jurisdiction.
17.3 EU Residents
If you are a consumer residing in the European Union, you may bring proceedings in the courts of your country of residence and benefit from mandatory provisions of your local law.
18. Dispute Resolution
18.1 Informal Resolution
Before initiating formal legal proceedings, please contact us at [email protected] to attempt informal resolution within 30 days.
18.2 Arbitration
Disputes that cannot be resolved informally may be submitted to binding arbitration where not prohibited by applicable law.
18.3 Class Action Waiver
To the extent permitted by law, you waive your right to participate in class action lawsuits or class-wide arbitration.
19. General Provisions
19.1 Entire Agreement
These Terms and our Privacy Policy constitute the entire agreement between you and Pets Club regarding the App.
19.2 Severability
If any provision of these Terms is found to be unenforceable, the remaining provisions shall continue in full force and effect.
19.3 Waiver
Our failure to enforce any provision of these Terms does not constitute a waiver of that provision.
19.4 Assignment
You may not assign your rights or obligations under these Terms. We may assign our rights without restriction.
19.5 Force Majeure
We shall not be liable for any failure or delay caused by circumstances beyond our reasonable control, including natural disasters, war, terrorism, pandemics, or technical failures.
19.6 Headings
Section headings are for convenience only and do not affect the interpretation of these Terms.
20. Apple-Specific Terms
As the App is distributed through the Apple App Store, the following additional terms apply:
20.1 Acknowledgment
These Terms are between you and Pets Club only, not Apple Inc. ("Apple"). Pets Club, not Apple, is solely responsible for the App and its content.
20.2 Scope of License
The license granted to you for the App is limited to a non-transferable license to use the App on Apple-branded products that you own or control, as permitted by the App Store Terms of Service.
20.3 Maintenance and Support
Pets Club is solely responsible for providing any maintenance and support services for the App.
20.4 Warranty
In the event of any failure of the App to conform to any applicable warranty, you may notify Apple for a refund of the purchase price (if any). Apple has no other warranty obligation with respect to the App.
20.5 Product Claims
Pets Club, not Apple, is responsible for addressing any claims relating to the App, including product liability claims, regulatory compliance, and consumer protection.
20.6 Intellectual Property Claims
In the event of any third-party intellectual property claim, Pets Club, not Apple, shall be solely responsible for the investigation, defense, settlement, and discharge of such claim.
20.7 Third-Party Beneficiary
Apple and its subsidiaries are third-party beneficiaries of these Terms. Upon your acceptance of these Terms, Apple has the right to enforce them against you as a third-party beneficiary.
21. Google Play-Specific Terms
As the App is also distributed through the Google Play Store, the following additional terms apply to Android users:
21.1 Acknowledgment
These Terms are between you and Pets Club only, not Google LLC ("Google"). Pets Club, not Google, is solely responsible for the App and its content.
21.2 Scope of License
The license granted to you for the App is limited to a non-transferable license to use the App on Android devices, as permitted by the Google Play Terms of Service.
21.3 Billing through Google Play
Subscriptions purchased through Google Play are subject to Google Play's billing policies and terms. You can manage and cancel your subscription through the Google Play Store app or your Google account settings at play.google.com/store/account/subscriptions.
21.4 Refunds
Refund requests for purchases made through Google Play must follow Google's refund policies. We do not process refunds directly for Google Play purchases.
21.5 Maintenance and Support
Pets Club is solely responsible for providing any maintenance and support services for the App. Google has no obligation to provide any support for the App.
